The instant dispute involves an ill-fated contract for the purchase and sale of software programs and services. Plaintiff ePresence, Inc. (“ePresence”) has brought claims against Evolve Software, Inc. (“Evolve”) for breach of a written contract, breach of a subsequent, oral contract, violation of M.G.L. c. 93A and breach of implied covenants of good faith and fair dealing.
