Babcock Borsig AG (“BBAG”), a German corporation, moves to compel Babcock Power Inc. (“BPI”), a corporation headquartered in Massachusetts, to produce documents and give testimony pursuant to 28 U.S.C. § 1782(a) for use in a potential arbitration between BBAG and Babcoek-Hitachi K.K. (“Hitachi”), a Japanese corporation, in the International Chamber of Commerce International Court of Arbitration (“ICC”).
