This matter is before the Court on two motions filed by Defendants Dunkin’ Donuts, Inc., and Baskin-Robbins USA, Co. (“Defendants”): a motion to dismiss Counts III, IV and V of Plaintiffs’ First Amended Verified Complaint pursuant to Federal Rule of Civil Procedure 12(b)(6); and a motion to strike Plaintiffs’ jury demand and multiple damages demand, pursuant to Federal Rule of Civil Procedure 12(f).
