Appeal from an order of the Supreme Court (Malone, Jr., J.), entered December 6, 2000 in Albany County, which granted defendant’s motion to dismiss the complaint for failure to state a cause of action.

Defendant is a corporation engaged in the business of providing food service to the airline and railway industries including, during the relevant time period, catering services to the Albany International Airport in Albany County and the Amtrak train station in Rensselaer County.
