Appeal from an amended order of the Supreme Court (Flatkin, J.), entered June 13, 2008 in Albany County, which, among other things, granted defendants’ motion to dismiss the amended complaint.
During the first half of 2001, plaintiff allegedly gave a total of $100,000 to defendants Daniel J. Yamin Jr. and Donald J. Walsh in exchange for their promise that he would be a part owner of Combined Solutions, Inc., the telecommunications consulting corporation that they were forming.
