HARPER, Judge.

Appellant was indicted, charged with assault to murder, and upon a trial he was convicted of aggravated assault, and his punishment assessed at two years imprisonment in the county jail, and a fine of one thousand dollars.

In this case it appears that Harry Hightower and appellant’s son, Jerome Day, had an altercation on Monday, January 19, 1909. Appellant was not at home that day, but upon returning home he was informed about the matter, and it angered him.
