The plaintiff in error, hereinafter referred to as defendant, was informed against in an information containing three counts. The first count charged the defendant with being a principal in the second degree to the forgery of a Western Union draft in the sum of $7500.00, alleged to have been perpetrated by one R. H. Bullock, with intent to injure and defraud the Western Union Telegraph Company. The second count charged the defendant as an accessory before the fact to the forgery, and the third count charged the defendant as an accessory after the fact to such forgery.
