I. INTRODUCTION

Plaintiff Mark W. Hammons, as next Mend for his minor son Jack M. Hammons, brought this suit in a Michigan court, on September 7, 2006, asserting state law product liability, breach of warranty, and negligence claims against Defendant ICON Health and Fitness d/b/a Pro-Form.
