MEMORANDUM OPINION AND ORDER

COFFMAN, District Judge.

This matter is before the court upon GE’s motion (Record No. 139) for summary judgment on LATAM’s counterclaims. The court, having reviewed the record and being otherwise sufficiently advised, will grant the motion in part with regard to some of LATAM’s fraud counterclaims (Counts 1, 2, 4, and 5) and deny the motion in part with regard to Count 3 (GE-DAKO).
