sitting in place of MR. JUSTICE STARK, disqualified, delivered the opinion of the court.

This action is before us on an appeal from a judgment entered in the trial , court quieting title in and to certain lands lying in Stillwater County, Montana. The action was com menced by plaintiff Albert L. Thomas and fifty-one other parties plaintiff, the complaint containing fifty-two separate causes of action, each being an ordinary short form statement, seeking to have some one individual plaintiff’s title quieted.
