Action to restrain defendant, as auditor of Tuolumne County, from drawing a warrant to pay the claim of one Richardson for printing the delinquent tax list for the year 1898 in a newspaper called the Mother Lode. The court found that Richardson was the proprietor of the paper on May 27,1899, and that the tax-collector of the county on that day caused the delinquent tax list for the year 1898 to be published in said paper for the period required by law; the list was duly published, and the bill for the work was allowed and ordered paid by the supervisors; the said newspaper was…
