HALBERT, District Judge.
This action to recover damages for personal injuries and wrongful death was originally filed in the Superior Court of the State of California, in and for the County of Del Norte. Defendant William E. Kelly filed a petition for removal of the cause to this Court, alleging that the action is one of which this Court would have original jurisdiction under Title 28 U.S.C. § 1332 (diversity of citizenship), and is removable under Title 28 U.S.C. § 1441.
