LEYET, District Judge.
This is an action by a school teacher and his wife against the New York City Board of Education and various individual agents of the Board of Education alleging discrimination on the basis of sex in its policy of granting child care leave. Plaintiff Gary Ackerman, the husband of plaintiff Rita Ackerman, applied for child care leave under former Section 107 of the Board of Education By-Laws.
