OPINION

SWEET, District Judge.

Defendant Postmaster General Anthony Frank has moved pursuant to Rule 12(b)(1) and (6), Fed.R.Civ.P., for an order dismissing the Title VII action brought by plaintiff Kathryn D. Babcock (“Babcock”) or, alternatively, for an order under Rule 56 granting defendant summary judgment. For the reasons set forth below, the motions for dismissal and summary judgment are denied. Defendant’s request for additional relief denying Babcock’s Title VII claim insofar as it seeks compensatory and punitive damages is granted.
