Action by the appellee against the appellant for a breach of marriage contract. The suit was commenced in the Wabash Circuit Court, and removed thence, on an application for a change of venue, to Miami county, where there was a verdict and judgment for the plaintiff for three thousand dollars. The questions presented for decision arise upon the motion for a new trial, the overruling of which is assigned as error.

Complaint is made that the court did not comply with the request of the appellant, that the instructions to the jury be given in writing, but the record does not show the request;…
