SOMMER TILLE, J.

[1] The plaintiff moves to dismiss the appeal taken by the defendant on the ground:

“That the amount in controversy in the instant case is, on the face of the transcript, less than $2,000.”

Plaintiff alleges in her original petition that the defendants refuse to pay her the sum of $258, and that they further deny to recognize your petitioner’s rights in the premises. She also alleges a contract between her and the mother of the defendants, now deceased, whereby she was to receive the sum mentioned semiannually during the remainder of her natural life;…
