This is an original action brought in the Supreme Court of the State of South Diakota by the plaintiff, E. A. Pietz, as receiver of the American National Bank of Redfield, S. D., against the State’ of South Dakota, as defendant. The plaintiff filed his complaint in the office of the clerk of the Supreme Court and served1 notice on the Attorney General and State Auditor. The Attorney General demurred to the complaint, and the cause, is now before this court for a determination of the merits of said demurrer.
