MEMORANDUM OPINION

CHURCHILL, District Judge.

In this action eighteen public college and public school employees, who are not members of the union which is their collective bargaining unit representative, allege that the union is attempting to collect service fees for the 1991-92 school year for constitutionally nonchargeable purposes.

The plaintiffs seek a declaratory judgment, injunctive relief, damages and attorney fees. They also seek class certification on behalf of all public employees who are required to pay a service fee to the union and who have challenged or will challenge the amount…
