Introduction
The plaintiff, Gary Mauser, has sued his employer, Raytheon Company, and the Ray-theon Company’s employee pension plan (“the Plan”) under the Employment Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq. Mauser seeks to have his pension, as computed on his salary for a pre-1981 stint of employment, reckoned according to the formula for the calculation of pension benefits that became effective in January, 1981 (the “Amended Formula”).
