Joyce v. John Hancock Financial Services, Inc.
District Court, D. Massachusetts
1Opinion of the Court
MEMORANDUM AND ORDER
YOUNG, District Judge.
John Hancock Financial Services, Inc. (“Hancock”) administered a Severance Pay Plan (“Plan”) for the benefit of its employees. Hancock did not administer the Plan perfectly, leading at least one former employee to believe that he had been cheated. This lawsuit followed. Although Hancock nonetheless prevails because sloppiness does not, without more, give rise to a cause of action, this putative class action should remind plan administrators that they have the utmost duty to carry out the plan competently and fairly on the behalf of beneficiaries.
