This was an action by the appellee against the appellant, as guardian of the minor children of Aquilla G. Granstaff, deceased, to recover for services rendered under a contract with such guardian, in boarding, lodging, clothing, and taking care of such minor children.

The complaint consisted of two paragraphs.

The appellant demurred to each paragraph, upon the grounds that neither of said paragraphs stated facts sufficient to constitute a cause of action, and that the court had no jurisdiction of the subject-matter of the action or of the person of the appellant, which demurrer was sustained as…
