MEMORANDUM OPINION
FARNAN, District Judge.
Plaintiff, Studiengesellschaft Kohle, mbH (hereinafter “SGK”) brought this action against Hercules, Inc., Himont U.S.A., Inc., and Himont Incorporated (hereinafter “Hercules, et al.”) for patent infringement and breach of contract. Defendants, Hercules, et al. counterclaim that SGK has breached an existing license agreement and violated the antitrust laws by enforcing, in bad faith, an invalid patent.
