This is a suit on a promissory note given by plaintiff in error John R. Price and R. R. Price to defendant in error for $13,500, on September 28, 1892, and payable one year after date. This suit was instituted on January 22, 1903, and the amended petition, on which the cause was tried, was filed December 27, 1904. It is alleged in the last named pleading that the note was protested for nonpayment on October 2, 1893.
