On May 17, 1907, appellant was a corporation organized under tbe laws of tbe state of Texas, with its principal office in tbe city of Houston, Harris county, Tex., but was .engaged in operating a sawmill for tbe manufacture of lumber at Bering, in Polk county, Tex. Appellees constituted a partnership, and were also engaged in tbe manufacture of lumber at Camden, Polk county, Tex.
