Appeal by the defendant, Alvaretta Merrill, as executrix, etc., of Alvin Seamans, deceased, frotn an order of the Supreme Court, made at the Steuben ■ Special Term and entered in the office of the clerk of the county of Steuben on the 3d day of December,' 1897, denying her motion to vacate and- set aside the verdict of a jury in the action and all proceedings had thereon.

Ward, J.:
This action was brought by the plaintiff against Alvin Seamans, defendant, to recover damages for a breach of promise of' marriage. The action Was brought: to trial at the Steuben Trial Term in Scptcm*613her, 1897, held by a justice of this court. The trial was commenced on September sixteenth, and continued until the afternoon of the eighteenth, when the jury at about two o’clock p. m., after a charge by the court, retired to deliberate upon their verdict.
