The defendant was convicted on June 13, 1881, at a court of Oyer and Terminer, in and for the county of Erie, held by Judge Daniels and two justices of the Sessions, under chapter 19 of the Laws of 1875, of the crimes of peculation and embezzlement. The jury rendered a general verdict of guilty, as charged in the indictment, but made no finding in respect to any loss resulting from the crime. Before sentence, the defendant sued out a writ of certiorari to review the conviction, which was affirmed by the Supreme Court, and afterward by this court. People v. Bork, 91 N. Y. 5.
