The questions involved in this case are substantially the same as those determined by this Court in the case of the People v. Johnson and others, decided at the last October Term. This is admitted by the counsel for plaintiff, and we are, therefore, asked to review that decision.
The first question raised by the record involves the construction of the eighth article of the Constitution of the State, and has been so fully considered in the opinion of this Court, in the case of the People v. Johnson, that there is little left to be said upon that point. The…
