Plaintiff, a preference eligible, served as a criminal investigator with the Drug Enforcement Agency (DEA) from July 1973 until November 1975. At that time, he was reassigned within DEA to the position of intelligence analyst, at the same GS grade and salary level as the criminal investigator job he had previously held, but without the opportunity to earn premium pay for overtime work. The reassignment was instituted by DEA after plaintiff was diagnosed as having a manic-depressive condition resulting in hyperactivity and disorientation.
