This was an action by the appellants mgainst the appellees, to recover possession of certain real •estate, being a house and lot in Lawrenceburg, in Dearborn •county, and to require The Indianapolis and Cincinnati Railtroad Company to execute to the plaintiffs a deed therefor, *490and to cancel certain deeds, under which Eliza J. Spooner claims the premises. The action was originally commenced, by Joshua Bates and Edward H. Neil; but Neil having died pending-the suit, his heirs were made plaintiffs in his stead.. Issue, trial by the court, finding and judgment for the defendants.
