This is an action to recover upon a creditor’s claim against the estate of Baltasar Corral. The argument of the appellant upon the rehearing is addressed to the point that the claim is not sufficient to support the complaint and particularly the second cause of action thereof. In this respect it is urged that a contract unenforceable because it is not in writing is presented and that on this account the claim can not be made the basis of a cause of action in any form.
