HALL, Chief Justice.

The appellee, Hume, brought this suit against the city of Amarillo to recover damages growing out of the act of th,e city in lowering the grade of Johnson, street upon which certain property owned by Hume abutted.

He alleged, in substance, that his lot fronted 250 feet on Johnson street and was valuable business property with trackage facilities because of the fact that on the east side said lot abutted upon the property of the P. & S.
