This cause has come before us on a motion for a temporary injunction under CR 65.07. An order granting such relief was entered on November 4, 1966, but due to the importance of the question involved, we set forth the reasons for our decision which effectively terminated the controversy.

This declaratory judgment suit sought the removal of respondent’s name from the ballot in a school board election held in Martin County on November 8, 1966. The principal ground of disqualification asserted was that respondent was not a legally qualified voter in the division of the district…
