O’QUINN, Justice.

This is an appeal by Mrs. Rilla O’Banion, sheriff of Shelby county, Tex., and Duke H. Herbert, of Nacogdoches county, Tex., from a judgment of the county court of Shelby county, overruling their plea to the jurisdiction of said court and their motion to1 dismiss the case from the docket of said court.
