Petitioner Gerald L. Naekel, through counsel, appeals the decision of the Merit Systems Protection Board (“the board”), Naekel v. Department of Transportation, 32 M.S.P.R. 488 (1987), denying in part his Petition for Enforcement. The circumstances of Mr. Naekel’s separation from his employment with the Federal Aviation Administration are set forth in this court’s decision reversing that action, Naekel v.
