RULING ON MOTION TO DISMISS

ALVIN W. THOMPSON, District Judge.

On December 23, 1998, Dean Tenn (“Tenn”) was ordered removed from the United States to Jamaica. He was deported on February 2, 1999. He reentered the United States by boat in September 2006. On October 28, 2008, a federal grand jury indicted Tenn for violation of 8 U.S.C. § 1326(a) and (b)(1), being unlawfully present in the United States after having been deported and removed from the United States subsequent to a conviction for the commission of a felony.
