This action was commenced in the district court of Canadian county, Oklu., by the El Reno Building & Loan Association, defendant in error, against Estella Collings, plaintiff in error, and T. J. Stewart Lumber Company for recovery on a promissory note and for the foreclosure of 'a real estate mortgage given to secure the same. T. J. Stewart Lumber Company filed a disclaimer, hence is not a party to the appeal.

The parties will be referred to herein as plaintiff and defendant in the order in which they appeared in the lower court.
