Appellant pleaded guilty, at a general court-martial, to one specification alleging an indecent assault, in contravention of Article 134, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 934. He also pleaded not guilty to one specification each alleging a rape and a breaking and entering of a dwelling room with intent to rape, in violation of Articles 120 and 129, UCMJ, 10 U.S.C. §§ 920, 929, respectively; these charges, however, were withdrawn by the Government, and, pursuant to his plea, appellant was. found guilty by the military judge of an indecent assault.
