The City of Louisville appeals the bench ruling for Bannum, Inc., in this action, brought pursuant to 42, U.S.C. § 1983,1 on the ground that the district court misapplied City of Cleburne v. Cleburne Living Center, 473 U.S. 432, 105 S.Ct. 3249, 87 L.Ed.2d 313 (1985).

Bannum owns and operates community training, centers (CTCs) under contract with the United States Bureau of Prisons (Bureau). The Bureau solicited bids from Ban-num and other companies for its CTC oper-, ation in Louisville in 1985 and again in 1988. In 1985, Bannum’s bid was accepted and Bannum…
