Acts 1939 (Comp. Laws Supp. 1940, § 16289-1 [1] et seq., Stat. Ann. 1940 Cum. Supp. § 27.3178 [1] et seq.) (probate code), the probate court has jurisdiction to hear and determine claims based upon torts against estates of decedents.
