The facts necessary to a proper understanding of the single issue involved in this review are these: The accused enlisted in the Army in August 1947. On September 5, 1949, which was prior to the expiration of his term of enlistment, he was stationed in Germany. On that date, pursuant to some prior arrangements, he was given an honorable discharge for “the convenience of the Government,” in order that he might re-enlist for an indefinite period of time. His discharge was dated September 5, 1949, and his re-enlistment was effective the following day.…
