This action was instituted in the superior court of Pottawatomie county by Alfred Williams against the Empire Oil & Refining Company, a corporation, to recover damages for an alleged malicious prosecution. Thereafter the action was transferred to the district court of that county. Upon trial the jury returned a verdict in favor of the plaintiff, and the defendant appeals from the judgment rendered thereon. We shall refer to the parties as they appeared in the trial court.
