Issues were joined and trial had upon the amended first paragraph of complaint, resulting in a verdict and judgment for appellee, who was plaintiff below. The jury found specially, by answering interrogatories submitted to them. The sufficiency of the amended first para*301graph of complaint was challenged hy a demurrer, which was overruled. The answer was a denial. Appellant’s motions for judgment on the answers to interrogatories and for a new trial were respectively overruled.
