GRAVES, Justice.
In August 1996, Appellee, the University of Louisville, began accepting bids for the construction of its new Papa John’s Cardinal stadium in accordance with the Kentucky Model Procurement Code, KRS Chapter 45A. The University’s construction plans involved seven different “packages,” including Bid Package No. 1 — Site Development, the subject of this case. After receiving all of the bids, the University determined that the low bids exceeded the construction budget.
