This was an action upon an appeal bond commenced by the plaintiff in error, plaintiff below, against the defendant in error, defendants below. Hereafter, for convenience, the parties will be designated “plaintiff” and “defendants,” respectively, as they appeared in the trial court. The trial court rendered judgment in favor of the defendants, to reverse which this proceeding in error was commenced.
