ORDER GRANTING IN PART AND DENYING IN PART DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT

The court heard defendants’ motion on November 21, 1994. Duane W.H. Pang, Esq., appeared on behalf of defendants; Jacob M. Merrill, Esq., appeared on behalf of plaintiff.
