HENDERSON, Circuit Judge:
On September 25, 1984, the steel frame of a building under construction collapsed, causing one death and several serious injuries. The primary contractor, The Sherman R. Smoot Company (Smoot), filed claims against both its subcontractor, Strait Manufacturing and Welding, Inc. (Strait), and Strait’s subcontractor, Williams Enterprises, Inc. (Williams).
