CORN, Vice Chief Justice.

Plaintiffs brought this action to recover the sum of $500 paid defendants as earnest money under a written contract for the purchase of a garage business in Tulsa,. Oklahoma. The cause of action, so far as-can be ascertained from the pleadings, was-based upon the alleged fraud and misrepresentation of defendant McDaniels, a real estate broker, in misrepresenting the location of the business plaintiffs contracted to-purchase from defendants Schmitz.
