Appellee, Dorothy Sell, joined pro forma by her husband, James B. Sell, sued appellant, Frederick Augustus Schluter, upon two causes of action, which arose as follows:

On June 16, 1920, appellee and appellant were married, and on January 25, 1922, they purchased certain real estate in Dallas, Texas, the partition of which is the subject matter of the first cause of action asserted herein by appellee, the parties having been divorced by court decree several years prior to the institution of this suit.
