This suit was brought by appellees as partners, against the sheriff of Fannin County and the sureties on his official bond, and the B. C. Evans Company, for the value of a stock of merchandise levied upon by the sheriff under attachment in favor of B. C. Evans Company against James Hancock, in February, 1890.
