This suit was brought in the district court of Harris county by appel-lees, O. T. Holt and C. M. McKinnon, hereinafter called plaintiffs, against appellant, Trinity County Lumber Company, hereinafter called defendant, to collect a debt alleged to be due by reason of the defendant wrongfully compromising a certain cause of action in which the plaintiffs owned a half interest, which half interest had been duly assigned to them by Eugenia Lott, for herself'and as next friend for her minor son, Harry Lott; said assignment was made after suit liad been brought, wag' in writing, duly acknowledged,…
